Schedules of Condition

If you are a tenant taking on a full repairing lease of a property, typically you will accept responsibility to repair and maintain the building in good repair, even if the building is not in good repair at commencement of the lease. This can have significant financial implications when faced with a dilapidations claim from your landlord and can lead to protracted negotiations and legal proceedings.

An accurate and thorough schedule of condition will record the state of repair of the property and document all defects at a given date, thereby providing a benchmark of the standard of repair in which the tenant is to maintain the property and subsequently return the property at the end of the lease.

If you are a landlord, a Schedule of Condition can be useful where a property is in good repair at commencement of the lease and also to ensure that a tenant has complied with their lease obligations.

We have considerable experience in preparing schedules of condition and handling dilapidation claims, which enables us to ensure that the schedule of condition performs its intended function.
